1. Agreement to Terms

By accessing or using The Collective's website, AI agent services, trading signal services, or any other services we offer (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and The Collective ("Company," "we," "us," or "our").

2. Description of Services

2.1 AI Agent Services

We provide custom AI agent development, deployment, and maintenance services. AI agents are software programs designed to automate tasks such as customer service, lead generation, data analysis, and other business functions.

2.2 Trading Signal Services

We provide cryptocurrency trading signals, which are notifications containing information about potential trading opportunities. Signals include entry prices, stop-loss levels, and take-profit targets.

2.3 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

3. Account Registration

To access certain Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. AI Agent Services Terms

4.1 Ownership

Standard Packages (Starter, Professional, Managed): The Collective retains ownership of AI agents created under these packages. You receive a license to use the agent for your business purposes while your subscription or maintenance agreement is active.

Custom AI Suite Package: You own the AI agents created under this package, including all code, configurations, and intellectual property specific to your custom solution.

4.2 Maintenance Fees

All AI agent packages require a monthly maintenance fee of $50 (except Managed package where maintenance is included). Maintenance includes:

• Software updates and bug fixes
• Platform compatibility maintenance
• Basic performance monitoring
• Technical support

4.3 Cancellation of Maintenance

You may cancel maintenance at any time. Upon cancellation:

• We will no longer provide updates or support
• The agent may stop functioning if integrated platforms change their APIs
• For agents owned by The Collective, the license to use the agent terminates
• For agents you own (Custom package), you assume full responsibility for maintenance

4.4 Delivery Timeline

We provide estimated delivery timelines but do not guarantee specific delivery dates. Delays may occur due to project complexity, client feedback cycles, or third-party dependencies.

4.5 Client Responsibilities

You are responsible for:

• Providing necessary access and information for integrations
• Timely review and feedback during development
• Ensuring your use of AI agents complies with applicable laws
• Monitoring agent outputs for accuracy and appropriateness

5. Trading Signal Services Terms

5.1 Nature of Signals

Trading signals are informational only and do not constitute investment advice, financial advice, or recommendations to buy or sell any financial instrument. Signals are generated by algorithms and may not be suitable for your financial situation.

5.2 No Guarantee of Performance

Past performance of trading signals does not guarantee future results. Cryptocurrency markets are highly volatile, and you may lose some or all of your investment. Win rates and performance statistics are historical and may not be representative of future performance.

5.3 Your Responsibility

You acknowledge that:

• You are solely responsible for your trading decisions
• You should conduct your own research before trading
• You should only trade with money you can afford to lose
• You should consult a licensed financial advisor if needed

5.4 Subscription Terms

Signal subscriptions are billed monthly or annually as selected. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel anytime from your account dashboard.

6. Payment Terms

6.1 Pricing

Prices for our Services are listed on our website. We reserve the right to change prices at any time, with notice provided for existing subscribers.

6.2 Payment Processing

Payments are processed through third-party payment processors. By providing payment information, you authorize us to charge your payment method for the Services you purchase.

6.3 Refund Policy

Trading Signals: We offer a 7-day money-back guarantee for new subscribers. To request a refund, contact us within 7 days of your initial purchase.

AI Agents: Due to the custom nature of AI agent development, refunds are evaluated on a case-by-case basis. If we fail to deliver an agent meeting agreed specifications, we will either revise the agent or provide a partial refund.

6.4 Failed Payments

If a payment fails, we may suspend access to Services until payment is resolved. Repeated payment failures may result in account termination.

7. Acceptable Use

You agree not to:

• Use the Services for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Services
• Share your account credentials with others
• Resell or redistribute our Services without authorization
• Use AI agents to generate spam, malware, or harmful content
• Use trading signals to manipulate markets

8. Intellectual Property

8.1 Our Property

The Services, including all content, features, functionality, software, and trademarks, are owned by The Collective and protected by intellectual property laws.

8.2 Your Content

You retain ownership of content you provide to us. By providing content, you grant us a license to use it as necessary to provide the Services.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF TRADING SIGNALS
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that AI agents will meet all your requirements or that trading signals will result in profits.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COLLECTIVE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any trading losses resulting from use of trading signals
• Any damages resulting from AI agent outputs or actions
• Any damages exceeding the amount paid by you in the 12 months prior to the claim

11. Indemnification

You agree to indemnify and hold harmless The Collective and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your trading activities

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Services ceases immediately
• For AI agents owned by The Collective, your license terminates
• We may delete your account and data after 30 days
• Provisions that should survive termination will remain in effect

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations.

14. Changes to Terms
